This Agreement is a public offer to individuals and legal entities (hereinafter referred to as the Users) on the following:
1. TERMS AND DEFINITIONS
Company – BP GROUP KFT…
Company Website is an Internet site whereby the Company shall provide the services specified in paragraph 2.1. of this Agreement. The Website is hosted at: www.ndcafe.hu, www.newdaycafe.hu
User is a person intending to buy Goods and services of the Company and its Partners through the services of the Website.
Partner is a legal entity (or an individual entrepreneur) with whom the Company shall be entered into an agreement and which shall intend to sell Goods and services to the User. The information about partners is indicated on the Website.
Goods and services are goods sold and services provided by the Company and its Partners, detailes of which shall be posted on the Website.
Order is a User's application aimed at purchasing the Goods or services of the Company and its Partners, as well as rent of premises, received by the Company through the website or in any of the ways provided on the Website.
Agreement (End User License Agreement) is this Agreement governing the relationship of the Company with the Users in the process of providing the services provided for in paragraph 2.1. of this Agreement.
The acceptance of the End User License Agreement shall mean that the User has read all the terms of this Agreement and fully and unconditionally agrees with them, including:
- granting consent to the processing of the User's personal data on the terms specified in the Agreement and the Privacy Policy (regulation on the personal data protection) of BP GROUP KFT posted on the telecommunication network Internet at the address: www.ndcafe.hu, www.newdaycafe.hu
- granting consent to receive an e-mail, SMS, and other types of mailings of information and advertising content, including from the Company's Partners.
The End User License Agreement shall be considered to be accepted in the cases specified in paragraph 2.4. of this Agreement.
2. SUBJECT OF AGREEMENT
2.1. Under this Agreement the Company shall provide the User with services for providing access to the services of the Website, including the personal account, services for providing information about Goods and services, NEW DAY business cafe.
2.2. This Agreement shall come into force from the moment you start using the Website www.ndcafe.hu, www.newdaycafe.hu;
2.3. This Agreement may be changed by the Company at any time without any special notification to the User.
2.3.1 In the event of changes to this Agreement, its updated version shall come into force at the time of posting its text on the Website, unless otherwise provided by the updated version of the Agreement.
2.3.2 The current version of the End User License Agreement shall be posted on the Website at the address: www.ndcafe.hu, www.newdaycafe.hu
2.3.3 Carrying out any action on the website after posting an updated version of the Agreement, the User shall express his full and unconditional acceptance of all its terms.
2.3.4 The User shall have the right to refuse to accept changes to the Agreement by stopping the use of the Website.
3. SERVICES
3.1. The services provided by the Company as defined in paragraph 2.1 shall be for informational purposes only.
3.2. To be able to use the services of the Company, the User shall have a device with Internet access.
3.3. The order of any service on the Website shall be made by the User independently.

4. WEBSITE LOGIN AND SECURITY
4.1. To log in the Website, the User shall agree to provide information in accordance with the login form hosted on the Website, pass the login procedure on the Website, and agree to the terms of this End User License Agreement by confirming the item "I accept the terms of the End User License Agreement" or in any other way provided for on Website or in this Agreement.
4.2. The Company shall have the right to suspend or cancel the login of the User and refuse him to use the Website.
4.3. The user shall solely responsible for all actions that will be carried out on the Website using his registration data.
4.4. The User shall undertake to immediately notify the Company about any case of unauthorized (denied) access with his username and password and/or any security breach.
5. COPYRIGHT AND RELATED RIGHTS ON MATERIALS HOSTED ON THE WEBSITE
5.1. All objects hosted on the Site and accessible with its help, including design elements, text, graphics, illustrations, videos, sounds and other objects (hereinafter referred to as the content of the Website), as well as any content hosted on the Website, are objects of exclusive rights of the Company and other copyright holders.
5.2. The use of content, as well as any other elements of services shall possible only within the functionality of the Website. Any content hosted on the Website shall cannot be used without the prior permission of the copyright holder. By use shall be meant, including: reproduction, copying, processing, distribution on any basis, display in a frame, etc. The exceptions are cases expressly provided for by Hungarian law.
5.3. The use by the User of the content elements of the Website, as well as any content for personal or commercial use, shall be allowed provided that all copyright protection marks, trademarks and other references to authorship are preserved, while the name of the author/copyright holder is preserved unchanged and the corresponding object is preserved unchanged. The exceptions are cases expressly provided for by Hungarian law.
6. LIABILITY LIMITATIONS AND RESERVED RIGHTS
6.1. The User shall use the Website on his own responsibility. The Company shall disclaim any responsibility, including for the compliance of the Website with the goals of the User;
6.2. The User shall have no right to make changes, create derivative products of the Website, as well as participate in their sale or otherwise in whole or in part use the content of the Website.
6.3. The User shall undertake to use the Website only for lawful purposes.
6.4 The User shall undertake not to host on the Website and not to send anywhere through/by the Website any materials:
- violating Hungarian law;
- containing threats and insults that discredit others;
- violating citizens' rights to privacy or public order;
- being obscene;
- in varying degrees violating the honor and dignity, rights and legally protected interests of others;
- contributing to or containing calls for inciting religious, racial or ethnic dissension;
- containing attempts to incite hostility or call for violence;
- materials that inveigle other persons into illegal behavior, involving criminal, civil and other liability or in any way violating the provisions of the law.
7. CONFIDENTIALITY
7.1. The User's personal data shall be processed in accordance with the Law on Personal Data and the Privacy Policy (Data Protection Regulation) BP GROUP KFT
7.2. When login on the Website, the User shall provide the following data: Name, e-mail address, contact phone number.
7.3. Providing personal data when login or ordering on the Website, the User shall agree to receive information from the Company regarding:
- informing Users about their services,
- promoting of goods and services,
- conducting electronic and sms surveys,
- control of marketing campaigns,
- customer support,
- organizing the goods delivery to Users,
- holding prize draws among Users,
- monitoring the satisfaction of Users with the services quality provided by delivery services.
7.3.1 The User shall agree to his data transfer to Partners acting on the basis of the Agreement with the Company to the extent necessary to fulfil obligations to the User.
7.4. The processing of personal data shall mean any action or set of actions performed using automation tools or without using such tools with personal data, including: collection, recording, systematisation, accumulation, storage, clarification (updating, changing), extraction, use, transfer (including transfer to third parties, not excluding cross-border transfer, if the need for it arose in the course of fulfiling obligations), anonymisation, blocking, deletion, destruction of personal data.
7.5. The Company shall have the right to send to the User on behalf of itself, independently or with the involvement of Partners, informational messages, including service and advertising messages, to e-mail, mobile phone or through used services (social networks, instant messengers, and others).
7.5.1 The User shall have the right to refuse to receive advertising and other information without explaining the reasons for the refusal.
7.5.2 The service messages informing the User about the Order and the stages of its processing (in case of technical implementation of such possibility) shall be sent automatically and cannot be rejected by the User. These messages may be sent on behalf of the Company by a third party, which is a technical Partner for sending the message, with whom the Company has a corresponding agreement.
7.6. The Company shall have the right to use "cookies" technology on the Website. It shall not contain confidential information, have the right to transfer information about "cookies" to Partners, agents and third parties who have concluded agreements with the Company in order to fulfil obligations to the User and for the purposes of statistics and optimization of advertising messages.
7.6.1 The data collected by cookies is anonymous. You may delete all cookies that are already on your computer hard drive by searching for and deleting the files with “cookies” in it. In addition, if you want to prevent the storage of cookies on your computer, you may change your browser settings so that cookies are blocked. 7.7. The Company shall receive information about the IP-address of the Website visitor. This information shall not used to identify the visitor.
7.8. The Company shall be not responsible for the information provided by the User on the Website in a public form.
7.9. In order to control the quality of service, the Company shall have the right to record telephone conversations with the User. At the same time, the Company shall undertake to prevent attempts of unauthorized access to information obtained during telephone conversations and/or transfer it to third parties not directly related to the execution of Orders.
8. FINAL PROVISIONS
8.1. This Agreement has been drawn up in accordance with the current legislation of Hungary.
8.2. All possible disputes regarding this Agreement shall be resolved in accordance with the norms of the current legislation of Hungary.
8.3 By accepting this Agreement, the User shall confirm that he is familiar with and understands all of its terms, expresses full and unconditional consent to all of its terms, including in terms of providing the Company with consent to the collection, storage, processing, transfer of his personal data (in accordance with the provisions of this agreements) and to receive e-mail, sms and other types of mailings of information and advertising content, including from the Company Partners.
